We are now halfway through the 2015 General Legislative Session. While we have competed the important task of balancing our base budgets, significant work remains. We are gearing up for votes on the most pressing issues of the session, such as Medicaid expansion, election laws, final budgets, anti-discrimination, transportation funding, education funding, and many others.  If you have not yet taken my legislative survey and would like your voice heard on these issues, please do so at this link.

For the past six months, I have been working on HB 290, New Car Dealer Franchise Amendments. Under current law, a new car dealership cannot be located within 15 miles of an existing dealership that offers the same kind of cars for sale without seeking the approval of an advisory board. I believe the current law limits competition within a specific geographic area.

As I reviewed the current law, I was concerned with the impact in south Utah County as we continue to grow and develop. New car dealerships are outstanding corporate citizens and make significant contributions to the communities in which they reside. For example, my law office has participated in the Keys to Success program sponsored by Ken Garff, which has brought thousands of dollars to schools in the Nebo School District. For decades, Smith Ford has been a major sponsor of events in south Utah County. I am very excited to see Doug Smith bring back Dodge Chrysler to Spanish Fork.  New car dealerships bring significant tax revenue and support to the community.

The intent of HB290 is simply to encourage more competition in the marketplace and reduce the 15-mile boundary described above. As we continue grow in south Utah County, I am hopeful this legislation will aid in attracting additional new car dealerships. Click here for more information about this legislation.
